General Terms and Conditions – Sophie Mia Sydney

These General Terms and Conditions apply to purchases made through the Sophie Mia Sydney online store. By placing an order, you agree to these terms. These terms operate alongside your rights under the Australian Consumer Law (ACL). Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.

1. Definitions

In these terms:

  • Business, we, us or our means Sophie Mia Sydney and the legal entity that operates this online store.
  • Customer, you or your means a person who visits our website or purchases products from us.
  • Products means the clothing, accessories and other goods offered for sale through our website.
  • Order means a request to purchase one or more Products through our website.
  • Website means the Sophie Mia Sydney online store and any related pages or services.

2. Business Details

Please complete the legal business name, ABN and business address before publishing these terms.

3. Application of These Terms

These terms apply to all Products offered through our Website and to every Order placed with us. Before submitting an Order, you will have an opportunity to review these terms. By completing your purchase, you confirm that you have read and accepted them.

4. Product Information and Pricing

We take reasonable care to ensure that product descriptions, images, colours, sizes and prices are accurate. However, minor variations may occur, including differences caused by screen settings or manufacturing batches.

All prices are shown in Australian dollars (AUD), unless stated otherwise. Any applicable delivery charges will be displayed at checkout before you complete your purchase. Where applicable, GST will be handled in accordance with Australian tax requirements.

We reserve the right to correct genuine pricing, description or typographical errors. If an error affects an Order you have placed, we will contact you as soon as reasonably practicable and give you the option to confirm the corrected Order or cancel it for a full refund.

5. Placing and Accepting an Order

When you submit an Order, you are making an offer to purchase the selected Products. You will receive an order confirmation email, but this does not necessarily mean that your Order has been accepted if stock or payment issues remain.

An Order is accepted when we confirm that it has been processed or dispatched. We may refuse or cancel an Order where a Product is unavailable, payment has not been authorised, we identify a genuine error, or we reasonably suspect fraud or misuse. If we cancel an accepted Order, we will provide a refund for any amount paid for the cancelled Products.

6. Payments

Payment must be made using the payment methods available at checkout. You confirm that you are authorised to use the selected payment method. We may use third-party payment providers to process transactions. We do not normally receive or store your complete payment-card details.

7. Delivery

Our delivery arrangements and estimated timeframes are set out in our Shipping Policy. Delivery times are estimates and may be affected by carrier disruptions, public holidays, severe weather, peak periods, customs processing or other circumstances beyond our reasonable control.

We will provide reasonable assistance if an Order is delayed, damaged or appears to be lost. Nothing in these terms limits your rights under the ACL in relation to delivery or goods that do not arrive within a reasonable time.

8. International Orders, Customs and Taxes

For deliveries outside Australia, the recipient may be responsible for customs duties, import taxes, clearance charges and other fees imposed by the destination country. These costs are outside our control unless expressly included at checkout.

You are responsible for providing an accurate delivery address and for complying with applicable import requirements in the destination country. We do not guarantee that Products can be imported into every country. This clause does not limit any rights or remedies available to you under applicable consumer law.

9. Returns, Refunds and Exchanges

Our Returns and Refunds Policy explains our change-of-mind return process, applicable conditions, return postage arrangements and refund procedure.

You also have rights under the ACL if a Product is faulty, unsafe, significantly different from its description, or otherwise fails to meet a consumer guarantee. Depending on the circumstances, you may be entitled to a repair, replacement, refund or another remedy. These rights apply regardless of whether a Product was purchased at a sale or promotional price.

10. Product Complaints and Faults

If you receive a faulty, damaged or incorrect Product, please contact us as soon as reasonably possible at info@sophiemiasydney.com. Include your order number, a description of the issue and clear photographs where relevant.

We will assess the issue and provide an appropriate remedy in accordance with the ACL. We will not ask you to pay return postage for a Product confirmed to be faulty, damaged on arrival or supplied incorrectly.

11. Website Use

You must not use our Website unlawfully, interfere with its operation, attempt to gain unauthorised access, or submit false, misleading or fraudulent information. We may suspend or restrict access where reasonably necessary to protect our Website, business or customers.

12. Intellectual Property

Unless otherwise stated, content on the Website—including logos, text, photographs, graphics, designs and product descriptions—is owned by or licensed to Sophie Mia Sydney. You must not reproduce, modify, distribute or commercially use this content without our written permission.

13. Privacy

Our collection and handling of personal information is explained in our Privacy Policy. By placing an Order, you acknowledge that your information may be handled as described in that policy.

14. Limitation of Liability

To the maximum extent permitted by law, we are not responsible for loss caused by events beyond our reasonable control. Nothing in these terms excludes, restricts or modifies liability, rights or remedies that cannot legally be excluded under the ACL or any other applicable law.

15. Changes to These Terms

We may update these terms from time to time. The current version will be published on this page with an updated date. Changes will not affect rights or obligations that have already arisen under an accepted Order, except where required by law.

16. Governing Law and Disputes

These terms are governed by the laws of the Australian state or territory in which the business is legally based, together with applicable Australian law. We will first try to resolve complaints directly and fairly. Nothing in these terms prevents you from exercising rights under the ACL or seeking assistance from a relevant Australian consumer-protection authority or court.
